Nov 29, 2021 at 16:31 comment added r13 Doesn't the joist support the first floor? If that's the case, you need to talk to a structural engineer to find a better solution. Note, even you don't intend to get the permit from the ADJ, code violation and structural concerns can cause you problems with your insurance and the future buyer. Most importantly, your own safety.

If you're going to modify it (by adding some sort of ceiling) that is when you'd have to worry about meeting code & talking to your local building commission would 100% be the way to go. If all you're doing is painting it to make it look nicer, that shouldn't impact your grandfathering in any way.
