I really appreciate your knowledge. I have been dealing with this for a year. And he is very clever, with his design. This was no accident. I Suffered massive damage last year, when he uncapped the 4" black drain pipe, and I actually dried out. I was digging up my yard, didnt leave many options for him, he had to open the pipe.( I didnt know at the time ) We found the first set of pipes. YES 2" PEX. Within 2 weeks, my land was moving. My house was surveyed with over 2" of sinking, from Aug til Jan. And yes Im sure about the pex pipe. I found more yesterday.At the very front of my property line, wrapping to to his. I think I figured out why today! I think, he is circulating the water from sump to sump, there is a french drain, or rock pit or something too, somethings going on with that gutter system too and dumping to me, to avoid the metered water fee's! I think the last 4 years, hes been dumping water to me, thinking into my drain tile system, because Im still not metered. But we were floating. He has a basement suite, his residence and a rental laneway house. At least 9 people at all times. I roughly estimated today 3500 a year in water bills. Maybe more. Sure wasnt worth it tho...because get this,

I didnt want to add these details in my original question because its so unreal, but his footings on wall encrouch to me, he undermined my entire retaining wall,which is now split and seperated,undermined my garage foundation, and tore out 2 huge pieces of my garage foundation. Then because of the uncontrolled release of water, I washed out and dropped!If I didnt have tiebacks on my wall, I woulda been in his backyard. Its the worst and scariest thing I have ever experienced. massive damage in 12mos. looks like an earthquake rolled through my yard. and before you ask, my 84 year old dad lived here alone during construction. he didnt notice. I moved in 2 years ago to care for him, and starting noticing changes in saturation.

Its been a nightmare trying to figure out why, because without the why, I cant get the City to do a thing!! Civil matter. No help at all. So Ive been learning and thinking and watching. but hopefully, crossing my fingers, I got it today. Reported bylaw infraction, using my drainage to avoid fee's. Sewer design will be notified and hopefully investigate.

Maybe now, I can get an inspector over there. please please please

Then, Ill get to work on amending that landscape wall code :} there really is no need to be lower than frost line without a permit right????...otherwise its a drainage cutoff wall.. isnt it?

What is the concern2" pex? Is are you sure it isn't 2" pvc. Often perimeter drain is installed poorly with little to no slope or bellies. Often even if initially installed correctly uncompacted soil that the noisepipe is resting on can settle and make a previously properly slopped pipe slope the wrong way. How much higher is the sump end of the pipe? If Do you think water is coming from his sump and flooding your garage subsoil? Did his builder build your garage as well, how did a pipe from this build get under your garage slab?

I suppose if his property were at the lowest elevation of a gully and properties on either side are higher and each property as you move away is higher still then you could have a tendency for surface water to naturally flow to his property. In that scenario possibly building a concrete wall would mitigate/slow water moving onto his property. Coding and zoning wise though he doesn't have to allow water from your property to flow onto his. Whether the wall is built on the property line or a foot in would probably have the same effect, water that flowed onto your property possibly from the uphill seems likeneighbor would be prevented or at least slowed from draining out to his lot. So the construction of the wall might prevent or delay your water from coming onto his property. You might have a spring that would have naturally drained to his property - there is no rule that your neighbor has to manage water from your property. Your lot might have been benefiting from his naturally lower lot previously but that doesn't mean you shouldn'twere entitled to benefit from it. You might just need to add some drainage now - maybe all you need is to lower the pipe near your garage so it properly drains into his sump.

The other purpose for the wall might be to prevent your retaining wall from being undermined. If water is naturally flowing from your property to his and it flows from under your retaining wall then soil can migrate with it and your wall could then end up collapsing. Does your retaining wall have anyholes for water problemsto drain out or is it solid on his side? Building another retaining wall on his side such that the top of his retaining wall is higher than the footing of yours would prevent that. I'd guess that would be the purpose of his wall - not to manage water but to prevent undermining of your retaining wall.
